Terms and Conditions
Enjoyers Travel (sole proprietor Garifulin, trade name Enjoyers Travel), hereinafter referred to as "the Operator," offers tour services to any individual or legal entity (hereinafter "the Client") under the following terms.
By making a payment for any service, the Client fully accepts these Terms and Conditions. This agreement has the same legal force as a signed contract under Article 395 of the Civil Code of the Republic of Kazakhstan.
Specific tour details — itinerary, dates, times, included services, and pricing — are determined through direct communication (messengers, email) or as published on enjoyers.org. In case of discrepancy between sources, information on enjoyers.org prevails.
1. Services
1.1. The Operator provides tour services including, but not limited to: individual tours, group tours, walking tours, transportation, guide services, and entrance fees.
1.2. Meeting points, departure times, and exact routes may be adjusted by the Operator in coordination with the Client.
1.3. By making a payment, the Client confirms they have reviewed and agreed to the itinerary, date, time, and all conditions of the specific service.
2. Booking and payment
2.1. After agreeing on tour details, the Operator provides payment instructions. Payment constitutes acceptance of these Terms.
2.2. Full prepayment is required before the tour date, unless otherwise agreed.
2.3. Payment is accepted in KZT (Kazakhstani tenge) via:
- Kaspi Pay (Kazakhstan's main payment app)
- Direct payment link provided by the Operator
- Bank transfer to the Operator's account (details provided upon request)
- Other methods agreed in advance
2.4. If a separate written contract is required, its terms take precedence over these Terms.
3. Cancellation and refunds
3.1. Client cancellation policy:
- 7+ days before the tour — 100% refund
- 4–7 days before — 50% refund
- 2–4 days before — 30% refund
- Less than 48 hours — no refund
3.2. If the Operator cancels a tour, the Client receives a full 100% refund.
3.3. Refunds are processed within 5 business days upon written request to the Operator's email.
3.4. The Operator may reschedule a tour due to organizational reasons (insufficient group size, guide unavailability, vehicle issues) with advance notice to the Client. If the Client does not accept the new date, a full refund is provided.
4. Responsibilities
The Operator commits to:
- Provide services as agreed, with quality and on time
- Take all reasonable steps to ensure participant safety during tours
- Maintain confidentiality of Client information
The Client commits to:
- Review and accept these Terms before payment
- Follow safety instructions and guidelines provided by the guide
- Pay for services on time
- Obtain travel and medical insurance independently, unless insurance is explicitly included in the tour package
5. Liability
5.1. We take all reasonable steps to ensure your safety during our tours. Our liability for any claim is limited to the total amount you paid for the tour, except in cases of death or personal injury caused by our negligence, for which liability cannot be excluded under applicable law.
5.2. The Operator is not liable for:
- Weather conditions, route closures, or national park access restrictions
- Damage resulting from the Client's own negligence or failure to follow safety instructions
- Lost, stolen, or forgotten personal belongings
- Missing travel documents (passport, visa, permits) that prevent service delivery
5.3. No-show policy:
- Group tours: arrival more than 15 minutes late is considered a no-show
- Individual tours: arrival more than 45 minutes late is considered a no-show
In case of a no-show, no refund is provided.
5.4. The Client is responsible for the conduct of all members of their group.
6. Travel insurance
We strongly recommend that you obtain comprehensive travel insurance covering trip cancellation, medical expenses, and personal liability before your trip. Enjoyers Travel does not provide insurance coverage unless explicitly stated in the tour package.
7. Force majeure
7.1. Neither party is liable for failure to fulfill obligations due to force majeure: war, natural disasters, government restrictions, route closures, or other unforeseeable events.
7.2. If force majeure lasts more than 24 hours, both parties will discuss alternative arrangements or contract termination.
8. Complaints
8.1. If you are not satisfied with our services, please contact us at denis.ganshin@enjoyers.org within 30 days of the tour date.
8.2. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.
9. Governing law
9.1. These Terms are governed by the laws of the Republic of Kazakhstan. Any disputes shall be resolved in the courts of Almaty, Kazakhstan.
9.2. This does not affect your statutory rights as a consumer under the laws of your country of residence.
